TERMS & CONDITIONS OF BOOKING
Le Coin Perdu is a trading name of the Property Owners, Peter and Gwyneth MAUDE.

1. To make a Booking
When you have decided on your dates (minimum term one week, extendable in one-week blocks) you can secure your Booking by contacting us using the Booking Form to confirm availability. Your enquiry will be acknowledged by us by email providing you with a full and definitive schedule of costs and payment terms. Gas, electricity, laundry, property preparation and access to the private swimming pool are all included in the cost quoted.

Once you have submitted a booking request, the dates will be displayed as unavailable to other customers until we accept or reject the Booking and you confirm your requirement with payment of the Booking Deposit.

The principal hirer must be over 21 years of age at the time of making a Booking. The principal hirer is responsible for all party members and for complying with all terms and conditions of the Booking and for responsible use of the Property.

The Property Owners reserve the right to refuse any Booking if deemed unsuitable for the property.
Once the Initial Payment has been made by You (the Customer), and a Holiday Confirmation has been issued by Us (the Property Owners), a legally binding contract shall exist between you and us pursuant to which we will make the Property available for the period set out in the Booking on an exclusive and, as far as possible, an undisturbed and unhindered basis.
2. Confirming a Booking
A non-refundable deposit of 25% of the holiday booking cost must be made to secure the Booking. If however you are booking within four weeks of your holiday, payment must be made in full at the time of securing the Booking. Your holiday is not confirmed until you have received written confirmation from us that we have received the booking deposit. We reserve the right to refuse any Booking up until we have issued the written confirmation. As soon as you receive the confirmation, you should check it carefully. Any errors must be reported to us immediately. For any modifications to your Booking we reserve the right to charge an administration fee of €20.00.

3. Making a payment
Bookings and payment are made online directly with us using bank details supplied by us at the time of making a Booking. All prices are quoted in Euro and payments are to be made in Euro.

4. Balance Payment
The full balance of your holiday is due at least four weeks prior to holiday commencement.

5. Security bond
A Security Bond is required, normally €500.00 but may be higher for stays longer than one week, to be paid along with the final balance, which will be refunded within 14 days of your return provided there is no damage caused or misrepresentation of your booking.
6. Cancellations
You should notify us immediately in writing if you wish to cancel the Booking. A cancellation only takes effect when we have received written confirmation from you. If the Booking is cancelled after the balance of the Rental Charge becomes payable, such balance shall remain payable notwithstanding cancellation.
In the event of cancellation, the following charges apply:

Between 2 and 4 weeks - 50% of the total holiday cost unless the Property can be re-let,
in which case only the Booking Deposit will be held
2 weeks or less - 100% of the total holiday cost unless the Property can be re-let,
in which case only the Booking Deposit will be held

If the Property becomes unavailable for whatever reason, we will endeavour to find alternative accommodation for you of a similar type, standard and location. Alternatively, or if this proves impossible, we will refund any moneys paid.
7. Arrival and Departure
Your Property is available from 4:00pm on your day of arrival and must be vacated by 10.00am on your day of departure. Our garden team will require access from 9:00am but will remain outside and will not interrupt your packing and departure.

8. Keys
Keys will normally be available directly from us when we meet you on arrival. If circumstances prevent a personal greeting, the keys will be found in a key safe located at the Property. In this instance, details will be given on your day of arrival.

Lost keys will be charged at €50/set.

Keys not returned to the key safe at the end of a holiday or handed back to us in person (or posted through the letter box in the event of an early morning departure) may incur a charge of €25.00 against the Security Bond to cover the cost of providing manual access to the next guests.
9. Occupancy
During the period of the holiday, you (personally and on behalf of all other people visiting the Property) undertake (for the benefit of future guests at the Property and us):

that the number occupying the Property will not exceed the number detailed on the Holiday Confirmation
-
to show due consideration for other parties (to include, but not be limited to, refraining from abuses of the Property and/or dangerous, offensive or rude behaviour to us, our neighbours, our representatives or any third parties)
-
that the Property will be used solely for the purpose of a holiday by your party
-
to allow us or our representatives access to the Property at any reasonable time for any reasonable purpose
-
to keep the Property, furniture, utensils, equipment, fixtures and fittings in or on the Property in the same state of repair and condition as at the commencement of the holiday and to ensure that the Property is left in the same state of order and cleanliness in which it was found. We reserve the right to levy an additional charge for any extra cleaning required and for any consequential loss. Such charge will be deducted from your Security Bond.
In the case of infringements relating to items 1 to 3, access to the Property can be refused or you may be asked to leave before the end of your holiday. If this happens we will treat your holiday as having been cancelled by you and you will not be entitled to a refund of your holiday cost or compensation.
10. Bed linen and towels
Linen and towels will be in place in advance of your holiday and includes: bed sheets, duvet covers, pillow cases, bath towels, hand towels, bath mats and kitchen towels and swimming towels. Pillows, linen and towels for infants using the travel cot, for legal and hygiene reasons, are NOT supplied.

11. Damages
Accidents do happen and we accept this as a fact of life. Any significant damage caused, especially if deemed to be wilful, malicious or the result of negligence or abuse, may be charged against your Security Bond. This includes damage to the swimming pool liner and all parasols. In order to avoid a charge, we ask that you notify us immediately in the event that any damage is caused, regardless of size or cause.
Please note that the bread oven / garage is out of bounds and access should not be attempted. Similarly, the wood burner in the lounge should not be considered to be available for use. In either instance, breach of this condition may be considered to be ‘damage’ to the property.

12. Cleaning
Pursuant to Section 9, Subsection 5, on your departure, the Property is to be left at the same standard of cleanliness as you found it at the beginning of your holiday (including outside furniture, tables and barbecue). In the event that the Property is not left in a satisfactory state at the end of your holiday, additional cleaning will be charged at the rate of €25 per hour and the cost deducted from your Security Bond.
All rubbish, waste and recycling should be removed from the Property at the end of your holiday (rubbish bin/bag and recycling bin are provided), including used barbecue charcoal. Note that glass should not be mixed with other recycling. Rubbish, waste and recycling left in the property may also result in a deduction from your Security Bond.

Public waste bins and bottle recycling bank are located on the approach roads to the Property.

13. Pet policy
Unfortunately our welcome for pets has had to be removed. We apologise that this has been necessary due to damage caused.

14. Swimming pool
Our pool is made available to guests to enhance their holiday experience and should be treated with due respect. Safety is paramount and it is parents’ responsibility (or that of the principal guest). The principal guest should ensure that safety considerations are understood by all guests.
For the safety and enjoyment of all guests, now and in the future, and to preserve the condition of the pool, we do ask that:

suitable adult supervision is in place at all times
-
the motorised pool cover is closed at ANY time that the pool is not attended by a responsible adult and especially at night
-
the solar shower provided is used by all individuals before entering the pool in order that:
-
all efforts are made to prevent dirt and grass entering the pool
-
suntan lotion is removed before swimming
-
your body is as clean as possible
-
-
NO glass or chinaware is taken to the pool area
-
ONLY the swimming towels provided (or guest’s own towels) are used by the pool and that the household towels are NOT taken to the pool area
-
guests refrain from running beside the pool
-
pool filter and pool heater controls are not adjusted for any reason
In addition, DIVING IS STRICTLY FORBIDDEN as the pool is not deep enough for diving.
Finally, guests should accept that water attracts bugs (and some birds) and the presence of bugs will be especially likely if the pool is uncovered for an extended period. A net is provided for scooping bugs from the surface and bottom of the swimming pool.

15. Smoking policy
For the enjoyment of the property by all our guests, now and in the future, smoking is strictly forbidden anywhere within the property and its entrance lobby. If guests wish to smoke in the garden or elsewhere in the surrounding area, they may do so as long as no inconvenience or discomfort may be caused to any third party. In the event that guests do smoke in the garden or surrounding area, cigarette ends must be disposed of responsibly and not deposited on the ground.

16. Electrical Appliances
In the event an appliance breaks down during your stay, please inform us or our local agent immediately and it will be repaired or replaced as soon as possible. We will not pay compensation in such circumstances.

17. Electric vehicles
It should be noted that a dedicated charging facility for electric vehicles is not available at the property and charging of electric vehicles is strictly forbidden for safety reasons. Electricity consumption will be monitored and any abuse of the electricity supply may result in immediate termination of the rental contract, with no refund, or an additional charge being made.

Two public charging points are available in the village - located in the car park opposite the doctors and nurses surgery and next to the Salle des Fêtes on the Avenue du Strade.

18. Complaints and issues
Any difficulties or issues you may have must be reported both to us and our local agent, so that they can be rectified as soon as possible, as they cannot be rectified after your holiday. If you return home before telling anyone of your difficulties, we are unable to accept any liability.

19. Liability
Neither we nor our local agents shall have any liability for any death or personal injury or in respect of damage to, or loss of, such personal property, except when it results from either our, or our local agent’s, negligence or that of any employee of us or the local agent, providing they were at the time acting in the course of their employment.
All appliances, equipment and facilities are provided in good faith. Use of appliances, equipment and swimming pool is at the guest’s discretion. The owners cannot accept responsibility for any accidents or injury resulting from using the appliances, equipment or swimming pool.
20. Force Majeure
Compensation payments will not apply where we cannot fulfil our obligations to our guests due to circumstances beyond our control. This would mean any event we or our local agent cannot foresee with all due care - e.g. riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire, epidemic or health risk and similar factors.
21. Local conditions
Le Coin Perdu is situated in a rural area. It is therefore natural that animals, birds, insects and other wildlife will also be living in what they consider to be their habitat. It is possible that this wildlife may gain access to the house under certain weather conditions from time to time.
22. Insurance and travel documents
We recommend that you purchase appropriate insurance that matches your needs when Booking in order to minimise the financial risks associated with going on holiday ad returning home in the event of accident or other incident.

Remember that certain travel documents (e.g. health or entry visa) may be required when entering France that were not required before Brexit. Likewise, remember that certain products are not permitted to be brought into France (e.g. meat and dairy products) and that there are now limits on the quantity of certain products that may be taken back into the UK. You should consult relevant information services to determine if there are any conditions that will affect you and your travel plans.

23. Data Protection
For the purposes of the Data Protection Act 1998, the General Data Protection Regulation (Regulation EU 2016/679) (“GDPR”) and any subsequent data protection legislation, we are the sole data controller of all personal data provided to us. We will only deal with the personal details supplied by you that we require to make a Booking and to manage your holiday. We have appropriate security measures to protect this data and will never share any information with any parties other than those details required by our local agent to serve you during your stay.
24. Website
The website for Le Coin Perdu contains a number of photographs to provide site visitors with a visualisation of the property. These photographs are non-contractual and the owners reserve the right to change photographs, decor, property details and contents at any time.
